Lawyers and judges faced a dilemma after the thirteen colonies won their independence because there was no publication of American legal reports during the colonial period on which American courts could base decisions instead of English law. Connecticut was the first state to address the problem and the legislature passed an act in 1784 requiring judges to submit written judgments which could be kept on file with the clerk of the court. There was no provision, however for the publication of the judgments. Ephraim Kirby, a private citizen, recognized the need and found the subscribers to support his assembling the reports. As a result, this is the first publication of decisions of an American court, the Superior Court of Connecticut, and Kirby is distinquished as the first reporter of court decisions, compiling the first volume of law reports in America.
